TERMS AND CONDITIONS OF USE OF MYCHART AT BROOKLYN HEALTH

The Brooklyn Hospital Center ("TBHC") is pleased to offer you access to portions of your medical record via a Web-based version of our electronic medical record called MyChart at Brooklyn Health. MyChart at Brooklyn Health does not reflect the complete contents of the medical record. To use MyChart at Brooklyn Health, you must accept these Terms and Conditions by clicking "I Accept" below.

You hereby specifically authorize TBHC to release your personal health information to you via MyChart at Brooklyn Health, and acknowledge and agree that your access to your health information (or, if applicable and authorized, that of your minor child) is for your personal use only, and that for a more detailed explanation of test results or other information received through MyChart at Brooklyn Health, you should communicate directly with your appropriate health care professional at TBHC. This authorization will remain valid unless/until it is revoked.

This authorization may cover disclosure of information relating to alcohol or drug abuse, genetic testing, psychiatric care and/or confidential HIV related information. You may revoke your authorization to provide your information by terminating your MyChart at Brooklyn Health account.

TBHC reserves the right in its sole discretion to revoke your access to MyChart at Brooklyn Health at any time for any reason. TBHC also reserves the right to discontinue providing MyChart at Brooklyn Health access altogether.

Response to Electronic Communication - TBHC's staff will make reasonable efforts to provide a response to electronic inquiries within two (2) business days. Accordingly, urgent or emergency situations requiring immediate attention should not be submitted electronically; instead, call 911 or go to your nearest emergency room.

Web Site Links - MyChart at Brooklyn Health may offer links to related medical Web sites not managed by TBHC. These Web site link(s) are for a patient's informational purposes only. TBHC does not endorse and has not verified the accuracy of the information in/on these Web sites, and the patient should not rely on any of the information found on the Web sites for purposes of treatment or diagnosis.

PRESCRIPTION INFORMATION AND REFILLS IN THE EVENT THAT YOU RECEIVE PRESCRIPTION REFILLS THROUGH THE SITE, YOU ACKNOWLEDGE AND AGREE THAT SUCH RENEWAL IS BEING PROVIDED SOLELY ON THE BASIS OF, AND IN RELIANCE UPON, THE ACCURACY AND COMPLETENESS OF THE MEDICAL INFORMATION HELD BY THE HEALTH CARE PROFESSIONAL ISSUING SUCH REFILL, AND IT IS YOUR RESPONSIBILITY TO ENSURE THE ACCURACY AND COMPLETENESS OF THE INFORMATION HELD BY THAT HEALTH CARE PROFESSIONAL BEFORE REQUESTING ANY REFILL.

Minor Eligibility - An individual must be age 18 or older to request a MyChart at Brooklyn Health account, unless the minor is allowed to consent to his/her own medical treatment pursuant to law or TBHC policy. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Third Party Access" section of these Terms and Conditions.

Third Party Access Individuals may request third party access to another individual's MyChart at Brooklyn Health account by completing the Proxy Consent Form accessible Here and submitting it to TBHC. Such access will only be granted to parties who have a legal right to the account holder's medical information (including but not limited to a parent, court-appointed guardian, health care proxy, and/or a surrogate under New York law) or have obtained that person's written authorization. TBHC reserves the right to revoke third party access at any time, for any reason.

E-mail Privacy Users of MyChart at Brooklyn Health will be notified via e-mail when there is new medical information to be viewed on MyChart at Brooklyn Health. This means that any person with access to a patient's e-mail account will be able to see this notification. Although no private medical information will be sent, the notification that new medical information is available by accessing MyChart at Brooklyn Health may be information that a patient would not want others to know. Thus patients should take this into consideration when providing an e-mail address.

Please know that if you send us an e-mail communication, it may be shared with the TBHC staff who assist in providing or administering the patient's medical care. A patient's confidential medical information on MyChart at Brooklyn Health will be accessible only to appropriate TBHC staff.

Security and Confidentiality - TBHC is committed to protecting the confidentiality of your medical information. We limit TBHC employees' access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time a patient accesses MyChart at Brooklyn Health. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. It is your responsibility to select a confidential password, to maintain that password in a secure manner, not to share the password, to change the password if you believe it may have been compromised in any way and to notify the TBHC staff if you believe that your password may have been compromised.

For other than general information viewing, MyChart at Brooklyn Health must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

Limitation Of Liability; Disclaimer Of Warranties - TBHC PROVIDES MYCHART AT BROOKLYN HEALTH "AS IS" AND MAKES NO WARRANTIES OR GUARANTEES OF ANY KIND, AND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND OR NATURE, WHETHER EXPRESSS, IMPLIED, OR STATUTORY REGARDING MyChart at Brooklyn Health, INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, CORRECTNESS, TIMELINESS OR USEFULNESS OF ANY INFORMATION, PROGRAMS, PRODUCTS, SERVICES, OR OTHER MATERIAL PROVIDED THROUGH MYCHART AT BROOKLYN HEALTH, OR OF RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TBHC MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE THAT YOUR ACCESS TO MYCHART AT BROOKLYN HEALTH WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE, OR FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS, AND SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED.

YOU AGREE THAT IN NO EVENT WILL TBHC OR ITS AFFILIATES, AND ITS AND THEIR TRUSTEES, OFFICERS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, SPONSORS, AND AGENTS BE LIABLE TO YOU, ANYONE CLAIMING BY, THROUGH OR UNDER YOU, OR ANYONE ELSE FOR (I) ANY DECISION OR ACTION TAKEN, OR NOT TAKEN, IN RELIANCE UPON THE INFORMATION CONTAINED OR PROVIDED THROUGH MYCHART AT BROOKLYN HEALTH; (II) CLAIMS ARISING OUT OF OR RELATED TO MYCHART AT BROOKLYN HEALTH; (III) YOUR USE OF MYCHART AT BROOKLYN HEALTH; (IV) USE OR DISCLOSURE OF YOUR PERSONAL OR MEDICAL INFORMATION THROUGH USE OF MYCHART AT BROOKLYN HEALTH; OR (V) FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, POSSIBLE HEALTH SIDE EFFECTS, LOSS OF REVENUES, PROFITS OR SAVINGS AS A RESULT OF MYCHART AT BROOKLYN HEALTH, EVEN IF TBHC KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, DEMANDS, OR ACTIONS.

These Terms and Conditions, and your use of and access to MyChart at Brooklyn Health are governed by the laws of the State of New York, without regard to its conflict of laws rules. Jurisdiction and venue for any cause of action arising hereunder shall be Kings County, New York.

These Terms and Conditions may be amended by TBHC at any time without notice. Your next use of MyChart at Brooklyn Health without objection shall be deemed to be accepted of the new Terms and Conditions

By Accepting, I am agreeing to the foregoing Terms and Conditions governing my use of MyChart at Brooklyn Health.

USE OF THIRD-PARTY SERVICES

You may choose to use other services provided by third parties in conjunction with your use of MyChart. Such services may include, but are not limited to, translation services, location services, and other third-party offerings. Any links to such services are provided for your convenience only. Neither Epic nor Brooklyn Health have control over the contents of these services, and neither Epic nor Brooklyn Health accept any responsibility for them or for any loss or damage that may arise from your use of them. Such services may require you to submit your information to a third party, which may result in a copy of your information being used and/or stored by a third party. If you decide to access any such services in conjunction with your use of MyChart, you do so entirely at your own risk and subject to the terms and conditions of use for such services.
